What is Debt Counselling?

Many consumers ask “What is debt counselling?”

Debt Counselling, also referred to as Debt Review is a process that helps consumers who can not make ends meet. A Debt Counsellor will reduce their monthly debt instalments by entering into negotiations with creditors. The Debt Counsellor will do assessments on the consumers’ income and expenses and then draw up a new payment plan

The New Debt Payment Plan

By drawing up the new payment plan, the Debt Counsellor frees up much-needed funds that the consumer needs to survive. Above all, the consumer will start to pay a reduced instalment from month one, so no more worries about debt!

The new payment plan will be discussed with the credit providers who in turn will have the right to either accept or counter the plan.

If there is a counteroffer by a creditor, our Debt Counselling experts will discuss this with our client. This does not in any way mean that the client will have to pay what he can’t afford. If the Debt Counsellor is not happy with a counteroffer, we will refer the case to one of our attorneys.

Legal Protection Against Credit Providers

In addition to paying less, our clients will benefit from full legal protection, even if the creditors do not agree to our payment plan. This does not happen very often though as we have great relationships with most credit providers.

If a credit provider does not want to accept a payment plan, we will ask a Magistrate to intervene. Our attorneys will, on your behalf, go to court to get the plan accepted. You will not have to appear in court as a Debt Counsellor will be the applicant in the matter.
